CemVault provides cloud-based cemetery management software that enables you to digitize records, manage plots, process payments, and provide online search capabilities for families.

3. Account Registration

To use CemVault, you must:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Be at least 18 years of age or have legal authority to bind your organization
• Notify us immediately of any unauthorized access to your account

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Upload malicious code, viruses, or harmful content

5. Payment Terms

Subscription Fees

You agree to pay all fees associated with your chosen subscription plan. Fees are billed monthly or annually in advance and are non-refundable except as required by law.

Price Changes

We may change our fees with 30 days' notice. Your continued use of the service after a price change constitutes your acceptance of the new pricing.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.

6. Data Ownership and Responsibility

You retain all rights to the data you upload to CemVault. You are solely responsible for:

• The accuracy and legality of your data
• Obtaining necessary consents to store and process the data
• Compliance with applicable privacy laws and regulations
• Maintaining backup copies of your critical data

7. Intellectual Property

The CemVault service, including its software, design, and content, is owned by The Bumppoman Group and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without written permission.

8. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the service. We may perform maintenance or make updates that temporarily affect availability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BUMPPOMAN GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these terms shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Warranties Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify and hold harmless The Bumppoman Group from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms of Service. Upon termination, your right to use the service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where The Bumppoman Group is established, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the service. Your continued use after such changes constitutes acceptance of the new terms.
